Restrictions and Bylaws

There are two types of documents for an HOA, the deed restrictions, and the HOA bylaws. The deed restrictions are filed with the county (Delaware and Franklin Counties for the Overlook), and are legally binding restrictions on what a resident may do with their property. The Overlook revised our restrictions in March 2019. The guiding principle in the original and revised restrictions are to leave as much as possible to the City of Westerville zoning ordinances and have a short minimal HOA document.

HOA Dues

As of April 21 2025, our annual HOA dues are $175, and there is a $50 transfer fee when homes are sold. Payment can be made via Zelle to “treasurer@westervilleoverlook.com”. Checks should be made out to “Overlook HOA“. For either Zelle or check payments, please include your name and address.

Plat Maps and Easements

Plat maps are registered with the county by property developers and define property boundaries and easements for real estate. The Delaware and Franklin County auditor sites are the authoritative source for these plat maps, but for convenience of residents, we have included the plat maps registered with Delaware County for the Overlook. Maps are searchable on the county sites by plat name. The Overlook is divided into 2 plats, Overlook Section 1, and Overlook Section 2. We have also included the plat maps for the Walnut Bend neighborhood that borders the Overlook to the west and north, because the easements (including tree preservation easements) may be of interest to residents. Easements such as those for electrical lines are defined from the property line, and then lines or other items are placed WITHIN the easement. It is the property lines that act as the reference point of the easements, NOT the location of items within the easement. This Delaware County Plat and Survey Search tool is the official source for the Delaware County plat maps that listed above. To find a plat map for a given address, first search on the address you are interested in. Then from that property record, obtain the name of the plat that the address is in. Then, search for that addresses plat map.
